Definitions:

Dark & White Events Ltd (hereinafter referred to as D&W Events, us, we) 115 Bocking Lane, Sheffield S8 7BJ
“Clients” (hereinafter referred to as client, you, your) means the named person making a booking with D&W Events event. “Event” the named itinerary of activities as detailed by D&W Events.
The headings below do not form part of these conditions and shall not be taken into account in their construction or interpretation.

Bookings:

  • All bookings must be made online via https://trailrunningpeaks.co.uk/
  • All bookings are subject to availability.
  • Clients are required to accept the implicit risks involved in outdoor activities, the potential danger of personal injury or death.
  • Clients taking part in outdoor and other similar activities should be aware of, and accept these risks and be responsible for their own actions and involvement.
  • Clients must have a level of fitness appropriate for the chosen event and are responsible for bringing the appropriate equipment, details of which will be posted on the D&W Events website at the time of booking.
  • If, in the opinion of the D&W Events staff your fitness or equipment may compromise safety of an event we reserve the right to cancel or terminate your event. In these circumstances you will not be entitled to a refund or compensation.

Price & payment

The price of any D&W Events event or activity, including those sold by a third party with D&W Events acting solely as an agent will be as quoted on our site from time to time, except in cases of obvious error.

If there is an obvious pricing error in relation to an event which could have reasonably been recognised by you as a mis-pricing then we have the right to cancel any bookings issued in respect of the event and issue you a refund in respect of the same.

Event Payments:

To secure your place on any of our events you will need to make payment to cover the costs as set out in the event description. Your place will not be confirmed until your payment is received and processed.

Changes/cancellation by D&W Events:

D&W Events reserves the right to change any of the facilities, services and prices described in the event itinerary. We also reserve the right to cancel the event i.e. if the minimum number of clients required for an event is not fulfilled, we may have to cancel the event.

Minor changes to an event, such as a change to the start time, route etc etc – if we need to make minor changes to the event we will advise you of these changes at the earliest possible date.

Minor changes will not constitute a reason for cancellation. If a major change becomes necessary, we will notify you as soon as reasonably possible if there is time before the start of the event.

A major change would be a change to the event date(s) and/or location/destination. When a major change or cancellation occurs you will have the choice of accepting the change of arrangements, purchasing another event from us, or cancelling your event. Should you choose to cancel, we will refund all recoverable payments made directly to us in respect of the event. We will not however, be in a position to refund any personal expenses you may have incurred as a result of your booking such as travel expenses, equipment purchases, accommodation etc.

Liability/Insurance:

D&W Events recommends that all clients carry adequate insurance to cover the duration of any event and activities undertaken. The insurance should cover cancellation and curtailment, medical and emergency expenses (including repatriation), personal accident, injury and death. In the event of an emergency medical rescue and/or repatriation from an event by whatever means, the responsibility of such costs must be bourne by the client.

Disclaimers:

All clients are bound by appropriate event disclaimers which all clients must read and sign during the process of entering an event (either online, postal or on the day of an event).

Website:

D&W Events takes every effort to ensure that the information published on this website is accurate. However, we cannot accept any liability for the accuracy or content. Visitors who rely on this information do so at their own risk.

Photographs:

Photographs may be taken on events and D&W Events reserves the right to utilise these images for promotional purposes.

Kit & Weather:

Any information provided by D&W Events on such matters of climate, weather, clothing, baggage, equipment etc, is given in good faith but without responsibility on the part of D&W Events.

Registration:

Each registration is for a single or team user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network. Responsibility for the security of any passwords issued rests entirely with you.

No Dogs

DOGS – we are sorry but dogs are not allowed on any of our trail running events in order to comply with UK Athletics Insurance Policy

Variations

We may revise these Terms and Conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these Terms and Conditions may also be superseded by provisions or notices published elsewhere on our site.

Law & jurisdiction

This Agreement and any dispute arising out of if will be governed by English law. Any dispute or claim arising out of or in connection with this Agreement or its formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Data Protection Act 1998/General Data Protection Regulation (GDPR) 2018

The above regulations establish rights for individuals who disclose their personal information – where personal information is widely defined – to any organisation for any purposes involving processing of that information. Any organisation which processes information about living individuals is a data controller for the purposes of the Act; that is a person who determines the purposes for which and the manner in which any personal data are, or are to be, processed. A data controller is required by the Act to ensure that the data subject has, is provided with, or has made readily available to him/her certain specified information, including the data controller’s identity, the identity of any other person to whom he may disclose the information, and the purpose or purposes for which the data are intended to be processed.

The purposes for which the data are intended to be processed are as follows:

1. Comments, questions and feedback

If you send an enquiry by e-mail to either a specific contact or a general enquiry address identified on any D&W Events website, we will only use your personal details obtained from your enquiry to respond to your query or improve the site. In some instances, it may not be possible for D&W Events to provide the information requested directly. We shall delete your personal data once we have acknowledged your comment.

2. Newsletter sign up

If you voluntarily sign up to receive e-mail alerts, we will use the information you give us to provide the service(s) you have requested. We will hold the information you have provided for as long as you require access to the service requested. If you inform us that you wish to cancel a subscription, we will remove you from our mailing list and your details will be deleted from our records.

Your Rights as a Data Subject

As a data subject, you have various rights under the Data Protection Act & GDPR regulations, including a right of access to any personal data being held about you by D&W Events as a data controller. D&W Events will supply you with details of personal data we are holding about you if you submit a request (“subject access request”) to the info@darkandwhite.co.uk e-mail account.

Logos

The copying and use of the D&W Events logo and other D&W Events related logos or any other sponsors logos or event information is not permitted without prior approval of D&W Events. Permission requests should be emailed to info@darkandwhite.co.uk. Tell us who you are, the organisation you represent (if any) and how and why you wish to use our logo. Please include your contact details including name, address, telephone number and e-mail.

Virus protection

D&W Events makes every effort to check and test material at all stages of production. It is always wise for users to run an anti-virus program on all material downloaded from the internet. D&W Events cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material off the D&W Events website.
